Any reference to "we"/"us"/"our"/”Beauty Galaxy” in these Terms is a reference to Beauty Galaxy.

Any reference to "you"/"your" means you, the user of the Website.

By accessing this Website or when you place orders to purchase any of the products on the Website, you agree to be bound by these Terms.

Registering for an Account and Subscribing to Beauty Galaxy Emails

You must be over 16 to register for a personal account on the Website, subscribe to Beauty Galaxy emails and/or place an order with Beauty Galaxy.

Some of the products that we sell may be considered more appropriate to adults and could be subject to age or other restrictions in some countries. You must comply with all applicable laws and regulations of the country for which the products are destined for delivery. We will not be liable or responsible if you break any such law. By placing an order with us, you are confirming that you are of the appropriate legal age to purchase the items. If we discover that you are not legally entitled to order certain products, we will not be obliged to complete the order.

To order products using the Website, you have the option to register for a personal account or you may pay using other third party accounts. Any personal data that you provide us with during the registration process will be stored in accordance with our Privacy Policy, and may not need to be re-entered with each new order.

You will need to supply us via the online registration form with certain information including: your email address, first name, surname, password, billing address and, where applicable, a different delivery address. Once you click on the "Continue" button this information will be stored in our customer database. You can access, update or correct your personal account details via the "My Account" section of the Website. We will only use the stored data in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your password and email address and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website to confirm it corresponds with the account holder’s details and will not be responsible for losses suffered by you where your password or email address is used by someone else unless this is due to our negligence. You agree to notify us immediately if you become aware or suspect any unauthorised use of your password or email address.

We reserve the right to change or modify these Terms including for legal, regulatory or security reasons at any time. Whilst we will flag changes on the Website and/or send emails in relation to major changes, it is your responsibility to check the Terms for changes. If you do not agree to any of the Terms, then you can simply stop using the Website at any time. If you continue to use the Website without accepting the current Terms your continued use of the Website  indicates your agreement to be bound by these Terms and Conditions.

Pricing and Payment

All prices on our website are in the currency specified and are subject to change without notice. We accept various payment methods, including credit cards and online payment platforms. By providing your payment information, you authorize us to charge the specified amount for your purchase.

Promotion Codes

From time to time we issue Promotion Codes. We have a Promotion Code box situated at the "Order Summary" page where codes can be entered. You may only redeem one code at a time so we advise you to choose the promotion best suited to your purchase.

The Ordering Process and Order Confirmation

Your order via our online purchase order form constitutes an offer to us to buy the products you select from the Website. All orders are subject to availability and to acceptance by us. If we cannot accept your order, you will be notified by e-mail and you will have the option either to wait until the item is available from stock or cancel your order. This may be because the product is unavailable or because we have identified an error in the price or description of the product. We reserve the right to refuse to accept an order. All communications will be addressed to the email address you supply when you register.

By placing an order for the delivery of goods via the Website you are making an offer to Beauty Galaxy to deliver the goods described in your order under the Terms of the order.

You may select items from our range of products, details of which will be added to the "Shopping Cart" by clicking on the "Add to Cart" button. Before placing an order, you can view and amend your order details at any time by clicking on the "Shopping Cart".

By clicking on "Pay by Card" (or equivalent button for other payment methods) at Checkout, you submit an offer to buy the goods in the Shopping Cart.

Once you have placed an order for goods (and delivery if applicable) you will automatically be sent an email confirming receipt of your order (the "Confirmation Email") with a summary of the details of your order, which we recommend you print out and keep for your own records. The Confirmation Email does not constitute our acceptance of your order; it merely records the fact that Beauty Galaxy has received your order. Please check that all details in the Confirmation Email are correct. If not, or if you do not receive a Confirmation Email please contact our Customer Care Team. 

Beauty Galaxy will send a second email when we despatch your goods which shall constitute our acceptance of your order (the "Acceptance Email") at which point a binding contract of sale for products will be concluded between you and us.
We will retain a record of all orders accepted by us. You can find details about your recent orders by logging into your Account via the Website.

Shipping and Delivery

We strive to process and ship orders in a timely manner. However, we cannot guarantee delivery times as they may vary depending on the shipping carrier and destination. Any shipping fees and taxes will be calculated and displayed during the checkout process. Unless otherwise stated, delivery will be made from our warehouse to the address provided by you. For orders fulfilled by Beauty Galaxy we will endeavour to despatch the product to you within three working days of you placing your order and in any event within 7 working days beginning on the day after you place your order.

If we are unable to despatch the product within that time we will email to let you know and to give you an estimated delivery date. In these circumstances we will offer you the opportunity to cancel the order and receive a full refund.

Responsibility for the product remains with us until the goods have been delivered to the delivery address specified by you in your order. We accept no liability where you provide an incorrect delivery address or where you fail to collect the goods from the delivery address which you specified.

If for any reason you do not receive your delivery, please note that we will only consider claims for lost items sent 30 days after the latest due date for UK orders.

Additionally, we will not accept liability for lost orders if you select for your parcel to be left in a safe place or with a neighbour. Beauty Galaxy is not liable for any lost, damaged or stolen package claims of orders addressed to a parcel forwarding company. Beauty Galaxy is under no obligation to offer replacements or refunds for orders or items that are reported missing or damaged that we reasonably believe to have been delivered to a parcel forwarding company.

We want you to be happy with your purchase from us. If you are unhappy with the product in any way (for example if there is obvious damage to the item from transport or packaging damaged during transport) please contact our Customer Care Team as soon as possible.

Resale of a product

The products sold on the Website are not for re-sale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.

Cancellation Period For Online Purchases

You have certain rights under the law. You have 14 days from the date of delivery of your purchase(s) to notify us of a cancellation, followed by 14 days from the date of notification to return the unwanted purchase(s).

For all valid items returned within the cancellation period, you may notify us that you are cancelling your order but you do not have to. If you choose to do this, please contact us using our Contact Us form. Please give us a clear statement that you would like to cancel which includes your name, address, details of the order you wish to cancel and some contact information such as a telephone number or email address.

Returning Items

You must return your items by post to the Returns Address provided by us no later than 14 days after the day on which you notified us about cancellation to change your mind and return the items back to us.

Any returns are at your own risk. For your protection, We recommend that you return your items either by courier or by tracked post.

You must pay for any return delivery costs, except where the wrong item has been sent to you or the item is defective. 

The items need to be in the original packaging where it forms part of the goods (for example, boxed goods, garments and gift items). Where an item has a return policy swing ticket attached, it must still be attached and undamaged upon return. Items can only be returned for a refund if they are unopened, unused and in a re-saleable condition with all tamper-resistant seals, packaging and any cellophane intact. We recommend a photograph is taken of the item prior to returning it if you are concerned about damage during its return journey.

You have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, We may have a right of action against you for compensation. This applies to all items that are returned.

Refunds

We will refund you (or will arrange a refund on our behalf) in full for any items you return but will deduct from any reimbursement an amount equal to any diminishment in value of the items as a result of you handling the items beyond what is necessary to establish the nature, characteristics and functioning of the items.

If you are returning all items in your order, we will also refund the cost of the initial delivery to you, but only up to the cost of the standard delivery charge. We will not refund any Next Day, Express, Saturday or other premium component of any delivery charge. If you are not returning all the items in your order, the initial delivery cost will not be refunded to you.

You will be refunded using the same payment method originally used to purchase the returned item(s) (unless you have expressly agreed otherwise). If you cannot be refunded using the original payment method then please contact us to discuss the details. You will be refunded no later than 14 days after the day we receive the items you are returning.

Once a refund has been issued you will receive a confirmation email detailing the amount which has been refunded and the item(s) we received back.

Returning Incorrectly Sent Or Defective Items

In the unlikely event that you receive a defective or incorrect product, you will be entitled to receive a full refund or replacement.

Tier 1: within 30 days of receiving the defective item, you can choose to receive either a repair; or a replacement; or a full refund.
The Tier 1 right to reject, for perishable goods that would not be expected to last for 30 days, lasts only as long as such perishable goods would reasonably be expected to last.

Tier 2: if more than 30 days have passed after you received the goods, you can claim a repair or a replacement of the defective item (but not a refund).

Tier 3 if the repair or replacement is not possible, or if it is unsuccessful or cannot be provided to you in a reasonable time, then you can choose to either:

keep the defective item and claim a price reduction (the amount of the price reduction will be determined by us depending on what is reasonable in the circumstances); or
return the defective item and claim a refund (but note that if you have had the goods for more than 6 months, this refund may be reduced to take account of any use you have had from the goods).
If you think you have received a defective item, please return the items back to us including details where possible of: Your Order Number, Product Code/Product, Name, Details of the fault, Whether you would prefer a refund or a repair or replacement
We will examine the returned items and notify you of your refund or repair or replacement by email within a reasonable period of time.

We will process any refund due to you as soon as possible and, in any case within fourteen (14) days after the day we confirm by e-mail that you are entitled to a refund for defective items. The refund will be made to the same payment method originally used by you to make the payment (unless you have expressly agreed otherwise).

Where an item is confirmed as faulty, we will bear the reasonable postage costs of returning the items up to the cost of the standard delivery charge. We will not refund any Next Day, Express or other premium component of delivery.

Limitation of Liability

Beauty Galaxy shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use our website or products. We make no warranties or representations, express or implied, regarding the operation or availability of our website or the accuracy, reliability, or completeness of the content.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of [insert applicable jurisdiction]. Any disputes arising out of or relating to these terms and conditions shall be resolved exclusively in the courts of [insert applicable jurisdiction].
